13. Recruitment & Staffing Terms

A. Candidate Ownership

Candidate ownership validity periods may apply as per signed agreements.

B. Candidate Information

Candidate resumes and profiles remain confidential and may not be shared externally without authorization.

C. Hiring Responsibility

Final hiring decisions remain solely with the client.

Mindhind does not guarantee:

  • Employee performance
  • Retention duration
  • Future conduct of hired candidates

D. Replacement Policies

15. Service Availability

While Mindhind strives for uninterrupted services, we do not guarantee:

  • Continuous uptime
  • Error-free functionality
  • Uninterrupted access
  • Complete compatibility across all systems

Scheduled maintenance, upgrades, and external dependencies may temporarily affect availability.

16. Limitation of Liability

To the maximum extent permitted by law, Mindhind shall not be liable for:

  • Indirect damages
  • Consequential losses
  • Business interruption
  • Data loss
  • Revenue loss
  • Reputation damage
  • Cyber incidents
  • Third-party failures
  • Delays caused by external vendors

Maximum liability shall not exceed the total fees paid for the relevant service engagement during the preceding three months.

Clients agree not to directly hire, solicit, or engage Mindhind employees, contractors, or consultants outside agreed commercial arrangements during active engagements and for a specified period thereafter, unless otherwise agreed in writing.

22. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of India.

Any disputes arising from these terms shall fall under the exclusive jurisdiction of courts located in Chandigarh, Punjab, India.

23. Amendments & Updates

Mindhind reserves the right to:
